AZ09-01 Washington Street Annexation Proposal

RECENT ACTIONS:

The City Council conducted a Public Hearing on December 1, 2009 and adopted Ordinance 5282, which annexed the 12.5 area into the corporate limits of the City; assigned zoning in accordance with Resolution 77-138; and required the assumption of existing city indebtedness (1996 Library Bond).  The annexation is effective on December 10, 2009.

BACKGROUND:

In November 2008, the City Council reviewed a section of Washington Street in order to determine if opportunities existed to even out the city boundaries and reduce the administrative burden of tracking which properties are in the city and which ones are

 not. Due to the number of single-lot annexations that have been processed in this area, the boundary has become irregular.  This becomes difficult to manage, particularly related to Public Safety, which properties are within our jurisdication and which ones are not.  The proposed annexation is being processed utilizing the Petition Method of Annexation (RCW 35A.14.120).

A Notice of Intent was initiated March 2, 2009 through Power of Attorney’s representing at least 10% of the assessed valuation within the proposed annexation area. The proposed area contains 10 parcels with an estimated assessed valuation of $915,360.

The City Council conducted a Public Meeting on April 07, 2009, and unanimously accepted the petition, required the simultaneous adoption of zoning regulations and the assumption of existing city indebtedness, and directed staff to refer the annexation to the Benton County Boundary Review Board (BCBRB).  No requests for review were received by the BCBRB during the 45-day review period, so the City was allowed to proceed with processing this proposal. A formal petition was circulated to all property owners and the petitions that were returned, along with any Power of Attorney agreements the City had on file, were submitted to the Benton County Auditor on August 18, 2009 for a determination of sufficiency.  The City received a Certificate of Sufficiency from the County for this annexation and scheduled the final Public Hearing for December 1, 2009.
